Council's refer an application to subdivide land to relevant referral authorities, including Melbourne Water. We review applications and inform council of our decision if we accept the proposed changes and consent to the new plan of subdivision being certified.

​Most subdivision applications require an application for a planning permit to subdivide under the Planning and Environment Act 1987, and an application for certification under the Subdivision Act 1988.

Subdivision is the process whereby a parcel of land is divided into two or more parcels, or multiple parcels are consolidated into one or more plans. Certification helps ensure that the Plan of Subdivision is satisfactory. A plan cannot be certified until a planning permit has been issued by council if a planning permit for the subdivision is required.​

We will assess all applications received from councils and recommend that the plan be either:

  • certified

  • certified with amendments

  • not certified

We might request more information before we make a recommendation about certification.

Duration

The process takes 28 calendar days to assess an application and respond.
