Certification at end of construction 3.14

​Due date for completion 3.14.1

Unless otherwise specified in the agreement, the due date for completion of the construction of the works is 12 months after the date of the Acceptance of the offer (due date).

Certification statement 3.14.2

When all works have been completed to comply with the requirements of the drawings and specifications, the owner must submit the following information to us by the due date:

  1. Construction certification statement
  2. survey 'As constructed' certification statement
  3. 'As constructed' survey information

The certification statement must:

  • be in the form supplied
  • include any supporting documentation specified
  • be authorised by the owner's nominated representative

We won't accept the Construction certification statement if we have reason to believe there are discrepancies between the condition of the works as certified and as constructed.

Certificate of practical completion 3.14.3

Following receipt of the Construction certification statement and supporting information, and provided there are no discrepancies between the condition of the works as certified and as constructed, we'll issue a Certificate of practical completion.

For works where we're inheriting an asset (no reimbursement), detailed costings of the asset must be submitted prior to the Certificate of practical completion being issued. This enables us to record the true value of the asset, which we're obliged to do under our financial governance.

Letter of release 3.14.4

Following satisfactory receipt of the information specified above and compliance by the owner with all other conditions of the agreement, we'll issue a Letter of release to Council for the subdivision.

Defects liability period 3.14.5

The defects liability period commences from the date of the Certificate of practical completion.

Main drainage works are transferred to us following completion of the defects liability period. Only appropriately qualified people we have authorised are permitted to enter our drains. Prior to transfer, the asset remains the responsibility of the developer and the contractor.

The owner is responsible for all reasonable costs incurred by us during the defects liability period. These costs will be included when the account is finalised. We reserve the right to extend the defect liability period. Such extended period will be specified in the special conditions of the agreement

The owner must submit an End of defects liability period certification statement at the end of the defects liability period.

The certification statement should be in the form supplied and include any supporting documentation as may be appropriate.

The owner's nominated representative must certify all works still comply with the Construction certification statement and the construction of the development's roads and other services is complete.

We won't accept the End of defects liability period certification statement if we've reason to believe there are discrepancies between the condition of the works as certified and existing.
