There may be a condition inserted in a planning permit that says the developer must enter into an agreement with Melbourne Water to provide drainage services for the development. Conditions specified would have to be complied with before Melbourne Water would consent to council granting a permit by providing a ‘Statement of Compliance’.

In this case the developer will need to apply to Melbourne Water to seek the conditions that need to be met to satisfy Melbourne Water’s requirements. An ‘Application for Offer of Conditions of Agreement for the Provision of Stormwater Facilities’ will need to be completed.

Melbourne Water will respond with one of two types of a letter of offer:

Non-works offer

A non-works offer usually requests that you pay a contribution towards the funding of waterways and drainage infrastructure that services new subdivisions or development. However, there are no requirements to actually construct any infrastructure. A non-works offer will be provided within 28 days from the date of application.

Works offer

A works offer will specify any contributions required, and will also specify works that are to be constructed by the developer and the reimbursement arrangements that will enable the project to proceed. A works offer will be provided within 60 days from the date of the application.
